TSC Intern Teachers Now Demand Full Salaries After Court Ruling: TSC intern teachers, numbering around 60,000, are now seeking complete compensation for their services following a recent court ruling. These teachers are employed by the Teacher Service Commission. However, they earn a fraction of what other teachers on permanent and pensionable terms earn.
They have announced their intention to pursue legal action
That is why they have announced their intention to pursue legal action to ensure they receive the full salaries owed to them for their work. The court ruling ordered the government to pay them their salaries in arrears. TSC flouted the law by paying them a stipend that goes against their right to fair compensation.
They were speaking during a press conference held in Nairobi through their spokesperson, Boniface Omari. Mr. Omari criticized the commission for failing to compensate them for the entire 15-month period of their employment.
The government owes them Sh26 billion
Omari asserted that they are taking legal steps to secure the compensation they deserve for the duration of their service to the Teachers Service Commission (TSC). This means that TSC owes them Sh26 billion in arrears.
Additionally, Omari emphasized the importance of the government intervening to ensure the commission complies fully with the court ruling. The law mandates TSC to ensure equal pay for teachers with similar qualifications. He stressed the need for the government to exert pressure on the commission to adhere strictly to this judicial decision.
TSC is likely to appeal the court ruling. They will definitely argue that they do not have a budget to comply with the court ruling. The commission had assured KUPPET that they will absorb 26,000 JSS intern teachers by the end of 2024.

Court proceedings uncovered a big discrepancy
Court proceedings uncovered that, despite being labeled as interns, these teachers were tasked with teaching a full curriculum. The curriculum involves subjects like sciences and mathematics. This extends beyond the scope outlined in their contracts. This discrepancy in responsibilities complicated their status as interns and highlighted the disparity between their workload and compensation.

Furthermore, despite receiving only a stipend as interns, their income was subject to full taxation. They even pay all the government deductions, including controversial levies like the housing levy. These financial deductions further exacerbated the disparity between their earnings and the compensation they rightfully deserved for their contributions to the education system.
Do you think the government will comply with the court ruling?
